Question for theme creators

If this is the case then we're all cream crackered on that front!!! :redface:

I've made a few theme's now using photo's and icons from the net.
Yes you could have a problem, I don't doubt that, but it would be almost impossible to get permission for all the stuff on the net.
Then there would be costs involved to be given the priviledge of using them later on.

A similar discussion is taking place with Mango Theme's and the copyright's to those. Again they belong to the maker, Aefox, but again some of the images and icons used in them could even fall under this problem.
I'm not trying to start another debate about it, but it's all revelant I think.

So far I haven't had any problems, but then again I'm not making money from my theme's and this fact would open up other issues.

It is very simple really: If you want to be legal, you actually (really, truly, absolutely) must ask for permission from the creator (or copyright holder, owner) for every single image you use, that you haven't created yourself.

If you do not get the permission, you cannot legally use someone else's work.

So, to be absolutely legal, you have to draw/paint the pictures on your own, or use photos or films you've taken yourself, or get the permission from whomever made it/them.

Then, of course, with wallpapers, themes, web pages, etc., it (breaking laws like this) does happen a lot.

That it happens a lot doesn't make it any more legal; it just means that a lot of people break the same laws.

Well, well, well we are quite the little bitch aren't we Aefox! And to think I even defended you when others where wondering about your theme's and phone problems.

For your information I'm not asking for copyrighted stuff, I already have some, eg any pictures on my PC from the net are most probably copyrighted, except for my own digi pic one's.

I'm on this forum cos I respect the rules of this forum and have not stepped outside of them or abused them.
If I'm thrown out I'm thrown out, but I've never publicised anything I do else where or condone what goes on elsewhere.
We all know what happens, there is no mystery there, but I'm not bragging about it.

Are you trying to tell me chantal, vanessa etc. are your girlfriends and you took the pictures?! Or did you digitally make them?
Or maybe the Body theme, or is that you?

These are what I was refering to in a nice way without offending you, but you seem to have something wedged somewhere that's giving you a nasty streak!

I do admire your work and you have a flair for art, but you are coming across as a nasty person plain and simple.

To be fair, i think the car from this theme looks suspiciously like a Porsche,
i doubt you got permission to use that car in your theme. Not only did you get
permission, you're trying to make money from it.

Thanks Coolice and N/A for helping to clear this up. Since my original post, I've been in contact with one of the artists whose work I wanted to use, and he's ok with it 😃
It wasn't my intention to start a 'name and shame' campaign. I merely wanted some clarification for my own pice of mind before undertaking an investment of my time. Sure, I could have just gone ahead and made them for myself, but I was hoping to share them with the community. Since that would mean putting them in the public domain, I was seeking some assurance that I wasn't going to end up getting sued!
btw, nice work, Alejandro! I hope you might consider giving me permission to use some of your custom icons. Feel free to pm me.

ok so let me get this yea, lets say i get a picture off the net of that hot car theme by mango orange and modded and stuff or get a pic of vanessa, and make it into a theme using only the image, icons are diff and rest all is diff. now is that illegal ? im kinda lost between this thing now. and plz dont go mad on me this is just a ?

Jesal, as I explained earlier (you may want to go back and read what's behind the link I posted, too), it is very, very simple: Using a picture in any way whatsoever without the copyright holder's (owner or creator) permission to do so is, indeed, illegal.

It is not a capital crime, but still illegal.

That thing is with who Jesal? ...

MangoThemes are all watermark on the menu.. and all has the copyright .. not printed like the text "copyrighted" on the theme pictures.. because the WHOLE theme it's copyrighted thing... that is the final product the theme not the pictures...

Anyway, all graphics material it's copyrighted before it's used on anytheme...

i can't made themes with graphic material not copyrighted by mango... or created by me.. and of course i have the permission ... i work for Mango... i have a signed contract...

i don't understand why people get it mad when discover that someone else are making all the things really in a legal way, all in the right way... it's that so hard to believe? ... you think that mango don't has lawyers out there?
