I know in the UK we have some really good distance selling and consumer laws (I have used them several times when suppliers wont accept a return that is clearly unsuitable or incapable of doing what its supposed to do, in this case the X doesnt receive calls or txt messages all the time and is therefore clearly faulty, this can be backed up further with most of the threads on this forum, I have even taken 2 companies to the small claims court and won each case (I initiated the collapse of a company called simply a bargain.com earlier this year because they would not refund my money when I cancelled an order that was not delivered on time, and through the simplyabargain forum at pricerunner UK others who had problems (and there were quite a few) followed suit)).
Even though I bought a french phone, it was bought through pixmania UK so I should be covered by UK trading laws, if they dispute the fact then I shall also take them to court (the best thing to do is slap a claim against them through the court as early as possible if they dont accept your return, they pay all fees if they lose the case).
I have just checked the site you mentioned and it seems to be spanish I think,I am not sure what the spanish consumer laws are so I really dont know if you qualify for a refund.
I am not sure how long you have had your phone, but some credit card companaies give warranties for faulty product, it may be worth checking with the card company you bought it through.
Other than that I am afraid I cany help you any further.
