i see the n90 has a newer version of symbian?
can teh n70 be flashed to this new version
or is it

a) not compatable with the hardware
b) no point

Where did you see that? It is not correct; the N70 and N90 both are based on the same Symbian OS 8.1a and Series 60 2nd Edition, Feature Pack 3 (a.k.a. Series 60 2.8).

Neither device's Symbian OS or Series 60 can be updated/upgraded to a newer version. The phone firmware may be updated, but the Symbian/Series 60 versions will stay the same.

my mistake i ment the n91 due in jan

The first phone based on Symbian OS v9 – the Nokia N91

I see. In that case it is correct; the N91 is based on Symbian OS 9.1 and Series 60 3rd Edition (3.0).

It is also still true, that there is and will not be any updgrades for the N70 to the Symbian and Series 60 versions the N91 uses (when available).
