as above really.
i have a couple of apps that would benefit from a silent alert (such as yahoo messenger and geominder) but from what i understand, nokia haven't given the 3rd party symbian software producers the right to access the vibrate function. is this correct? and if so, why?

Ask the developers of the apps in question to dig into their copy of the S60 SDK and use the calls documented there to turn the vibration on or off; it is there for anyone to use (at least in the S60 2nd Edition Feature Pack 3 C++ SDK I have currently installed on my PC).

Some phones firmware (S60 FP2) doesnt have vibractrl.dll and even if application supposed to use vibtation, it wont. If so, you should update your firmware.
