The Carphonewarehouse lost my phone!

I brought my Nokia N93 in October and started experiencing problems. So I took it into Carphonewarehouse to get it repaired. They guy in front of me in the queue had just had an argument with the customer service assistant, so when I told him my problem he was like... o yea well its probably that the phone needs flashing and the machine doesn�t work right now and it'll be two - three weeks until its sorted...

So was like hmmm... that's not quite right and tried to get it into repairs at the same place a just over a week later, and guess what! The guy I saw this time was very helpful and booked it into repairs took down details and the rest of the protocol and told me I should receive a text within three days to say its sorted but if I hadn't to come in anyway.

So that�s what I did (Friday 7th March) only to be told that the engineer had not even looked at it yet. Then told it should be done by Monday 12th March.

So my girlfriend went in whilst she was in town to pick it up for me, to be told that it had been fixed, but they couldn't find it anywhere but would ring her later that afternoon when they had. So when she went back expecting my phone to be all nice and fixed she was told that they had lost it - my �500 phone.

Does anyone have any idea on my rights?

Has this happened to anyone else?

It depends from country legislation! But they must give you a new one, and at the end, it was a fair deal.
