N95 Camera "photofix"?

I'm using an N95 with all the factories default settings to take pictures, however I have a couple of problems

1. When I turn the flash "off" I still get the flash - is there a reason for this?
2. If I take a photo of myself or a friend, the picture looks fine for the first 5 seconds, after which the phone performs a function similar to the "one step photo fix" or Paint Shop Pro fame. This results in an inaccurate representation of the picture I was looking for, and things like skin show up with terrible blemishes and wrinkles all over the place (my friends are in our early 20s, its putting a couple of decades on us!)

The second point is the most annoying, because previously using my W810i I was taking pictures of seemingly superior quality, for a couple of hundred pounds less.

Any help would be greatly appreciated.
