1. The NCC engineers can read the product code electronically out of the handset internal memory when it's handed in for repair - according to one forum user they can even do this with 'bricked' phones. However, you could always reset the product code to the original one after de-branding, then they NCC engineers shouldn't be able to tell the difference. If you do find yourself in need of NCC engineer repair, play dumb and do not own up to de-branding the handset. You might get away with it, you might not.
2. In my view, if your handset developes a hardware fault weeks or months after debranding the FW, then Nokia's invalidating of your warranty would not be legally enforcible. On the other hand, if you brick the phone during the de-branding process, the legal situation regarding the warranty would be much more uncertain. HOWEVER if an NCC engineer states that your warranty is void after discovering you de-branded the handset, then could you really afford to take legal action against Nokia? I think not, it would be cheaper to buy another N95 off eBay.
Many AAS forum users (including myself) have successfully debranded various N-series Nokia handsets using NSS and NSU, and this is unlikely to stop as long as Networks disable standard functionality of handsets, release buggy network branded FW versions, and delay branded FW updates for months after the generic FW is released.
The final decision to debrand or to wait for an official network branded FW upgrade is yours and yours alone.
