"phones for U" told me it would take about 10 days to get it back , after 17 days i called them, this is what they said " sorry but the phone has been deamed "beyond economical repair" due to the screen not working because of water damage (BOLLOCKS, WATER HAS BEEN NOWHERE NEAR MY PHONE) and if i would like to dispose of the phone free of charge they would do that (THANKS, NOT ! ! ! ) but if i wanted the phone back i have to pay £17.63 to get it back (rip off i think) i could off just taken the phone to my local market they would of repaired the screen for a tenner , now i don't know what to do , get the phone back or not , i was going to sell the phone on ebay but i don't know now if it will ever work , any advice ?????

Its easy to do, and will cost you nothing but a little time (apart from the initial fee (about 50 quid I think), which you claim back in the summons).
If you know for sure there was no water damage and the phone is still in warranty.
Goto https://www.moneyclaim.gov.uk/csmco2/index.jsp to make the claim online (its dead easy)
But first inform them that if they dont send you the phone back repaired or a new replacement phone as they have now said the phone is beyond economical repair and you know for a fact that it isn't water damage then you will be taking further action to recover a fully working N80 from them, or the cost of an N80 so that you will be able to purchase one elsewhere, also tell them that in the summons you will be claiming for court costs, all expenses and interest.
They will try to fob you off again, and if they do then send them the summons, they may try to counter it, but if you are correct in what you say then continue with the summons and you will get what you want....they have to prove that the phone is water damaged, and they should have a dated repair report, and also the phone as evidence.
I did this with pixmania and my Sendo X, they said that because sendo had gone out of busines then they would not honour the warranty, but I took the warranty out with pixmania, after sending them the summons from the court, and the still trying to fob me off, they eventually sent the money (350 quid) with a couple days to go before the judgement was entered against them, these companies dont want CCJ for something as simple as this.
