to those of you that have bought the P800 on the highest Orange tariff and have changed to the lower tariff .....
....can you please check your small print for anything that says about the 4 month tie-in????
Can you let me know if it is in there.
I have just spoken to someone at Orange and even though their billing line know nothing about the 4 month tie-in Orange will know that you have reduced your plan and actually send you a letter asking you if you want to give them 'clawback' money for the difference in cost of the phone, or if you want to go back onto the 4 month tie-in.

You already know my views on the matter.
There is nothing about a four month tie in on the contract form you
sign. The contract form does however refer to a separate
, more detailed, set of terms and conditions.
These are provided with the phone ( if you ask in the shop )
and can also be read at,

There is no mention of a four month ( somethimes refred to as 120 day )
tie in that I have seen.
There is a "minimum term" but this is the 12 months of the contract.
I would be very suprised if they sent me a letter asking for money
given these contract terms.
If I have missed something I would be very keen to know however
as there is a 14 day moneyback guaruntee in case of dissatisfaction,
and I would be very dissatisfied.

I cant help feeling though, that Orange have to get their money back somehow and I just thought I would warn everyone that is on the most expensive tariff that they may end up paying the top price for the phone in one way or another.
The phone is subsidised by Orange but that subsidy will be the same regardless of the tariff you are on. And thats why they have the 4 month tie-in on the high cost tariff with �199 for the phone.
Congratulations to you though if you get away with changing the tariff without any other charges.

the 4 month clawback is part of T&Cs of the RETAILER not Orange.
I have checked a few of them (mobileshop, onestopphoneshop) and it seems this way.

and the relevant T&C is:
14.1.3 In the event that you elect to downgrade your tariff in the first 120 days from your initial billing date ("first period"😉 we will invoice you in the sum of �100 plus VAT per handset. Should you change your tariff during the first 120 days from your initial billing date, either up or down, the "first period" starts again. It is in your interest not to change tariffs in the first 120 days from your initial billing date.
It seems that the clawback is to the retailer who passes it down the line....
From Page 13.22 of the "guide" that comes with the P800,
i.e. the actual contract terms
15 changes to your contract
we reserve the right to make changes to your contract
15.1 When you Register you are asked to choose a Price Plan and to
indicate which Orange Additional Services you require.
you may switch between Price Plans and add or cancel Additionals
by giving us not less than 10 days notice before your Monthly
Billing Date (subject to the terms of any promotional offers
you have accepted.
Then there is a bit about how, if they change prices a little, inform you and you do not argue for a month you have deemed to accept them.
Given this I can see how the sales assistants can say that you only
need to stay with a plan for one month as you only have to provide
ten days notice of change.
Sad really 😞 , should have been using my new toy last night rather
than pouring over contract terms.
