Seems my N97 may be busted - the other person in a call can't hear me or hear's me quietly/cutting out about half the time. Any advice before I send it back?

not had that issue myself, as for the cutting out this is a silly question i know but is your signal ok?
Might be worth trying the following before returning your phone.
1. Check your masts.
You can see where your nearest masts are, and whether they are 3G or not, here:-

2. Check your settings on phone.
Menu > Settings > Connectivity > Network > Network mode = Dual mode >Operator selection = Automatic.
Whilst on this screen you could also try the following to improve your connection lock:-
Change Operator selection to Manual and you will be shown all operators within range. Choose an operator other than your own and try to connect to them. You will receive the message, "Access denied", (or similar). Do this with different operators a couple of times and then finally select your own operator. You will then be accepted and taken to the main, front, screen.
Here you can enter *#105# and press the Green call key and the mast you are connected to is displayed.
Don't forget to go back to Network and change Operator selection back to Automatic.
